1. GENERAL

1.1. All products sold on the Mai Rotorua website are sold subject to these terms and conditions. The Customer should ensure that they have read them thoroughly prior to purchasing any products.
1.2. “Customer” means you and all other persons who purchase the products in your name.
1.3. The products are sold through the Mai Rotorua website from RotoruaNZ Ltd, “RotoruaNZ”, department Rotorua isite Visitor Information Centre, 1167 Fenton Street, Rotorua 3010, [email protected]

2. PRICE

2.1. Our prices are stated in New Zealand dollars inclusive of GST and you will be charged in New Zealand dollars.
2.2. A delivery fee which covers the costs of sending the customer's order will be included in the total price at the time of purchase. The RotoruaNZ is entitled to change this fee at any time and without prior notice.
2.3. Shipping is offered within New Zealand only.
2.4. RotoruaNZ may vary the prices of their products at any time without prior notice.
2.5. In the event that computer error results in a material misstatement of the Customer’s order RotoruaNZ may require that the Customer pay the difference between the amount charged for the order and the correct amount payable.

3. PAYMENT

3.1. The customer shall make payment of each order by credit card in full when placing the pre-sale order. We may also offer other methods and may change these methods without prior notice.
3.2. Whilst the order is placed on the Mai Rotorua website (www.mairotorua.com) your receipt and corresponding bank statement will show the charge from the Rotorua isite Visitor Information Centre (“Rotorua isite”). This equally applies to refunds.

4. PRODUCT RANGE & AVAILABILITY

4.1. All products are sold subject to their availability while stocks last. RotoruaNZ accepts no responsibility for its inability to supply products to the Customer where the product is unavailable or where stock has been exhausted.
4.2. RotoruaNZ reserves the right to limit quantities of the product.

5. DELIVERY OR PICKUP

5.1. RotoruaNZ delivers within New Zealand and is not able to ship overseas. RotoruaNZ will endeavour to deliver the product to the specified delivery address in a timely manner. RotoruaNZ takes no responsibility for any failure to deliver, or delay in delivery caused by events outside of its control.
5.2. Delivery timeframes are estimated timeframes and do not include unforeseen delays.
5.3. Property and risk in the Products shall pass to the Customer upon delivery to the Customer’s delivery address.
5.4. Nothing in these terms and conditions entitles the Customer to refuse to take delivery or return the products as being surplus to their needs or for any other reason other than those agreed herein.
5.5. RotoruaNZ reserves the right to withhold delivery of the Products to the Customer for any reason whatsoever.
5.6. Advice regarding order shortages or damage in transit must be given to RotoruaNZ no later than five days after receipt of products.
5.7. If an item is returned to us for a refund, any original costs of delivery do not form part of that refund unless otherwise agreed.
5.8. All parcels are non- signature required and are shipped via courier, which can be tracked. The tracking number can be obtained on request.
5.9. The estimated availability of the product is the 25th of October 2024, which is when they will be shipped or are available for pick-up in person.
5.10. The Customer will be notified via email should this date change.
5.11. The pick-up location is: Rotorua isite Visitor Information Centre, 1167 Fenton Street, Rotorua 3010 from 8.30 am – 5 pm daily.
5.12. Customers must present a valid phot ID and a copy of their presale order confirmation at time of pickup.
5.13. The Customers agrees to pick-up the product within eight (8) weeks after the product has become available for pickup. If the Customer fails to pick up the item within the specified timeframe, the Customer will be deemed to have waived their right to the Product and any refund. Ownership of the Item will transfer to the Customer upon successful pickup or shipping.
5.14. While the RotoruaNZ anticipates the games to be available at the 25th October 2024, unforeseen delays in production or shipping may occur. Customers will be notified of any changes to the expected availability date.
No refunds will be given due to a change in date.

6. ORDER VARIATION / CANCELLATIONS / RETURNS

6.1. For products including postage: The Customer may vary or cancel the order up to the point in time that RotoruaNZ has packed the order by contacting us via email: [email protected]. Should the order have been posted already, RotoruaNZ agrees to refund the cost of product but not freight charges incurred and not taking care of the postage to return the item.
6.2. For pickup products: The Customer may vary or cancel the order up to the 25th of October 2025 by contacting us via email: [email protected].
6.3. If for any reason, the Customer is dissatisfied with their order, they must contact RotoruaNZ within 14 days of receipt of the product via email: [email protected] for assistance.

7. REFUND POLICY

7.1. We do not accept returns on change of mind purchases so please choose carefully.
7.2. Proof of purchase must be included with any returned product.
7.3. Postage charges on returns are at cost of the Customer and are non-refundable.
7.4. RotoruaNZ is not liable for packages that are lost or damaged during the transfer. Once the package leaves our facility it is under the Customers ownership and the Customer/couriers’ responsibility.

8. USE OF CUSTOMERS INFORMATION

8.1. The Customer use of this website will generate certain information that will be recorded electronically by RotoruaNZ. RotoruaNZ will also record the Customer's contact details, and any related personal details that the Customer supplies. We do not record credit card details.
8.2. The Customer acknowledges that RotoruaNZ' employees may use the information identified in the previous clause for purposes connected with the supply of services to the Customer. Such services include keeping the Customer up to date with new offers from RotoruaNZ. RotoruaNZ agrees not to disclose any of the Customer's personal information without the Customer's consent.
8.3. The Customer may at any time make a written request to see any personal information that RotoruaNZ holds or to ask to correct any mistakes in that information.
8.4. The Customer may at any time request that RotoruaNZ remove their details from the database.

9. CONSENT TO RECEIPT OF ELECTRONIC MESSAGES

9.1. The Customer acknowledges that by agreeing to receive promotional material they expressly consent to their inclusion in RotoruaNZ' direct marketing database and accept that they may, as a result, receive electronic communications and promotional communications from RotoruaNZ. The Customer has the right to ask RotoruaNZ at any time to stop sending online communications and promotional offers to them.

10. SECURITY INFORMATION

10.1. RotoruaNZ shall use its best efforts to prevent any to prevent any unauthorised entry into the Mai Rotorua website. However, Mai Rotorua / RotoruaNZ shall not be liable for any damage or loss whatsoever if any third party gains unauthorised access to the site.
